Terms of Service

These Terms of Service ("Terms") govern your use of Gessoed ("the Service"), operated by Gessoed ("we," "us," or "our"). By accessing or using Gessoed, you agree to be bound by these Terms.

1. The Service

Gessoed is a web-based tool that helps painters create color mixing recipes from reference photos using their own paint palettes. The Service uses AI to generate mixing suggestions based on colors you sample and paints you register in your studio.

2. Accounts

You may create an account using Google authentication or a magic link sent to your email address. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must be at least 13 years old to use the Service.

3. Free Tier and Paid Access

Gessoed offers a free tier that includes up to 25 mix recipes. After reaching this limit, continued access to mix recipe generation requires a one-time payment of $15 USD, which grants lifetime access to the Service including all future features.

The free tier does not expire. Your studio data, projects, and saved mixes are retained regardless of your payment status.

4. Payments

Payments are processed by Paddle, our payment service provider. By purchasing lifetime access, you agree to Paddle's terms of service and privacy policy. All prices are in USD unless otherwise stated.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, scrape, or otherwise extract data from the Service
• Share your account credentials with others
• Use automated tools to access the Service in ways that place unreasonable load on our infrastructure
• Upload content that infringes on intellectual property rights

6. Your Data

You retain ownership of any content you upload to Gessoed, including reference photos and paint palette data. We do not claim any rights to your content. Reference photos you upload are processed to enable color sampling and are not stored on our servers beyond your active session.

Your studio data (paints, projects, saved mixes) is stored securely and associated with your account. See our Privacy Policy for full details.

7. AI-Generated Content

Mix recipes and suggestions are generated by AI and are provided as creative assistance only. Results are not guaranteed to be accurate for any specific application. You are responsible for evaluating the suitability of any mixing suggestion for your work.

8. Availability

We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect availability. We will not be liable for any losses caused by unavailability of the Service.

9. Intellectual Property

The Gessoed name, logo, and interface design are our intellectual property. The AI-generated recipes produced by the Service are yours to use freely for your personal and commercial artistic work.

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not warrant that the Service will meet your requirements or that mix suggestions will produce specific results. Your use of the Service is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you have paid to us in the 12 months preceding the claim.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or by displaying a notice in the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
